TERMS & CONDITIONS AND PRIVACY POLICY
TERMS OF USE
Park360 Limited registered in New Zealand, Company No. 6762435 whose registered office is at Level 5, 19
Victoria Street West, Auckland. GST registration number is 12 536 7348. Contact via email on
info@park360.co.nz (we, us and other similar expressions) offers the parking Booking service in accordance with
the terms and conditions set out below.
1 DEFINITIONS
ANPR System means a system that utilises Automatic Number Plate Recognition (ANPR) to convert vehicle
number plates into machine readable data.
Breach Notice means a notice attached to your vehicle and/or posted to the registered vehicle owners address.
Parking Fee means the fee (including GST) payable by you for the cost of parking in the Car Park during the
Booking Period.
Booking means the Booking of a parking bay at a car park that you request through the booking service by
selecting a start & end dates and times; and we accept by issuing you a Booking confirmation.
Booking Period means the period of time covering:
• the times set out in your Booking Confirmation to enter and exit the Car Park and
• The additional period of time during which you may enter the car park prior to the times set out in the
Booking Confirmation without incurring additional charges and which is specified as the Entry Grace
Period in your Booking Confirmation.
Car Park means the car park specified in your Booking.
Standard Rates means the rates for parking in the Car Park outside the Booking Period.
2 ACCEPTING THE TERMS
2.1 By completing the booking process, you agree to be bound by:
(a) these terms of use;
(b) the terms and conditions of the relevant car park displayed at the entry to the car park; and
(c) our Privacy Policy and our Website Terms of Use, which are incorporated into and form part of these terms of
use, (collectively, the Terms).
3 VARIATIONS
3.1 We may change the Terms at any time by publishing the varied terms on our website. You accept that by us
doing this, we have provided you with sufficient notice of the variation and agree to be bound by the most current
version of the Terms published on our website.
3.2 If you object to the Terms or any variation to them, or you become dissatisfied with your use of service in any
way, your only remedy, other than any remedy which cannot be excluded by law, is to stop using the service.
4 REGISTRATION
4.1 In order to make a Booking you may register as a user. You must be at least 18 years of age and be an NZ
resident to register. Registration is free.
4.2 We may refuse your registration at our sole discretion.
4.3 During the registration process you will be required to provide a unique email address and nominate a
password to be used to access your account. It is your responsibility to ensure that your password is kept
confidential at all times.
4.4 Your account is unique to you and is not transferable. You are fully responsible for all activities that occur
under your account.
4.6 You must ensure that any registration details you provide when registering are accurate and you must notify
us of any change to your registration details as originally supplied. You may do this at any time by logging into
the website and clicking on ‘Modify my details’.
5 BOOKING
5.1 You can request the Booking of a parking bay at a car park by accessing your account and completing and
submitting the online Booking form.

5.2 If your Booking request is accepted by us we will send you by email a Booking confirmation setting out details
of the confirmation.
5.3 A Booking is only valid for the particular time, date, product, price and Car Park set out in the Booking
confirmation.
5.4 You must not resell or lease a Booking.
5.5 We may limit the number of Bookings per person or per Car Park.
6 PAYMENT
6.1 Each time you make a Booking you must pay us the Parking Fee, using any of the credit or debit cards we
accept.
6.2 We will confirm the total Parking Fee before you submit your online Booking form.
6.3 You must include valid credit or debit card details on your online Booking form. By submitting your online
Booking form you authorise us to debit the Parking Fee from that credit card.
6.4 The details of the credit or debit card used when completing a Booking will be stored externally (in encrypted
format) on a PCI compliant Card Safe service. The credit or debit card details may be retained and be linked to
your account for future Bookings.
6.5 On completion of your Booking we will email you a Booking confirmation which will serve as receipt of your
payment of the Parking Fee.
7 CANCELLATION AND CHANGES BY YOU
7.1 You may cancel a Booking at any time no less than twelve (12) hours before the start of the Booking Period
and we will refund the Parking Fee to you for that Booking less a cancellation fee.
7.2 If you request to cancel a Booking less than twelve (12) hours before the start of the Booking Period we
reserve the right not to refund you the Parking Fee.
7.3 We will not refund your Parking Fee if you do not redeem your Booking unless one of the exceptions in
clause 8 apply.
8 CANCELLATION OF BOOKING BY US
8.1 In some circumstances we may cancel your Booking, elect not to provide you with the services requested in
your Booking, or be unable to provide you with the services requested in your Booking.
8.2 If an event in clause 8.1 occurs, we will refund you the Parking Fee, unless the event was caused by your
failure to comply with the Terms.
8.3 In no circumstances will we refund you the Parking Fee if our inability to provide you with the services
requested in your Booking is caused by you failing to attend the Car Park during the Booking Period.
9 BOOKING PERIOD
9.1 Payment of the Parking Fee entitles you to park your vehicle at any available parking bay at the Car Park
during the Booking Period. Parking Bays marked as Reserved are not available for use by customers unless
specifically stated.
9.2 If you arrive before the Booking Period starts or leave after the Booking Period ends, you may be charged
additional fees at our Rates (even if your total stay is for no longer than the Booking Period).
9.3 We will not provide any refund if your total stay is shorter than the Booking Period.
10 ARRIVAL AT CAR PARK
10.1 When you arrive at the Car Park you must follow the instructions set out in your Booking confirmation and
on any signs or road markings if this is stipulated.
10.2 At all times you must comply with the terms and conditions of the Car Park which are displayed in the Car
Park or on your booking confirmation.
11 DEPARTURE FROM CAR PARK
11.1 When you leave the Car Park you must follow the instructions set out in your Booking confirmation and on
any signs or road markings if this is stipulated.
12 VEHICLE RESTRICTIONS
12.1 Each Car Park has specific height limits for vehicles which must be followed. You must ensure that your
vehicle does not exceed the height limit for the Car Park.

12.2 You can check on the height limit for a Car Park by clicking on the link to the information page for the Car
Park on our website. You are not entitled to a refund of the Parking Fee if the vehicle used to access the Car
Park exceeds the height limits.
13 DIRECT MARKETING ACTIVITIES
13.1 As a registered user you consent to:
(a) us sending you electronic messages including SMS, MMS, and email regarding any promotional, marketing
and publicity activities that we may offer; and
13.2 You have the right to unsubscribe from receiving any further electronic messages of the kind described in
clause 13.1 by:
(a) by following the unsubscribe directions in electronic messages received from us;
(b) Emailing us at privacy@park360.co.nz or
(c) by updating your notification settings in the relevant section of our website.
14 TERMINATION AND SUSPENSION OF YOUR REGISTRATION
14.1 You may terminate your registration at any time and without notice by emailing us at
support@park360.co.nz
14.2 We may suspend or terminate your registration at any time by giving you 7 days’ notice, by email to the
email address associated with your account.
15 DISCLAIMER
15.1 We do not guarantee that:
(a) the Service will be available at all times;
(b) your use of the Service will be uninterrupted or error free;
(c) the Service will be available for use at all our car parks.
16 LIMITATION OF LIABILITY
16.1 Terms, conditions, warranties and guarantees implied by law which cannot be excluded, restricted or
modified apply to the Terms to the extent required by that law.
16.2 We exclude to the extent permitted by law all other terms, conditions, warranties and guarantees which
might be implied into the Terms.
16.3 You do not rely on any representation, warranty or other provision made by us or on our behalf which is not
expressly stated in the Terms.
16.4 Subject to clause 16.1 we do not accept responsibility for any loss or damage, however caused (including
through breach of contract, breach of statute, negligence or other tort), which you may directly or indirectly suffer
in connection with your use of the Service, nor do we accept any responsibility for any loss arising out of any
suspension or termination of your registration of or any variation of the Terms.
17 GENERAL INFORMATION
17.1 These Terms supersede any prior agreements between you and us in respect of the Service.
17.2 Our failure to exercise or enforce any right or provision of the Terms must not be treated as a waiver of the
right or provision.
17.3 If any of the Terms are held to be invalid, unenforceable or illegal for any reason, the remaining terms of use
are to continue in full force.
17.4 Your rights and obligations under the Terms are personal and may not be assigned or dealt with in any way
without our approval, which we may withhold in our absolute discretion.
17.5 The Terms and the relationship between you and us are governed by the laws in force in New Zealand,
without regard to its conflict of law provisions. You agree to submit to the personal and non-exclusive jurisdiction
of the courts in New Zealand.
PRIVACY POLICY
INTRODUCTION
Park360 Limited (we, us, our) complies with the New Zealand Privacy Act 2020 (the Act) when dealing with
personal information. Personal information is information about an identifiable individual (a natural person).
This policy sets out how we will collect, use, disclose and protect your personal information.

the Act, see www.privacy.org.nz.
CHANGES TO THIS POLICY
We may change this policy by uploading a revised policy onto the website. The change will apply from the date
that we upload the revised policy.

WHO DO WE COLLECT YOUR PERSONAL INFORMATION FROM
We collect personal information about you from:
• you, when you provide that personal information to us, including via the website and any related service,
through any registration or subscription process, through any contact with us (e.g. telephone call, visit
our website or email us), or when you buy or use our services and products
• third parties where you have authorised this or the information is publicly available.
If possible, we will collect personal information from you directly.
WHAT PERSONAL INFORMATION WE COLLECT ABOUT YOU
We may collect the following personal information about you when you use our services:
• full name
• email address
• mobile number
• license plate number (using ANPR systems installed at carpark facilities)
• transaction history
• financial information, including credit card details
• information from the Motor Vehicle Register about the registered owner of the
• vehicle you use (where necessary to enforce a Breach Notice)
• information about your use of our websites or applications, including information
• generated by cookies
• information about our interactions with you, including correspondence and call
• recordings
• credit information (if we need to conduct a credit check with your authorisation)
HOW WE USE YOUR PERSONAL INFORMATION
We will use your personal information:
• to verify your identity
• to provide services and products to you
• to market our services and products to you, including contacting you electronically (e.g. by text or email
for this purpose)
• to improve the services and products that we provide to you
• to undertake credit checks of you (if necessary)
• to bill you and to collect money that you owe us, including authorising and processing credit card
transactions
• to respond to communications from you, including a complaint
• to conduct research and statistical analysis (on an anonymised basis)
• to protect and/or enforce our legal rights and interests, including defending any claim
• for any other purpose authorised by you or the Act.
DISCLOSING YOUR PERSONAL INFORMATION
We may disclose your personal information to:
• another company within our group or service provider to us including any enforcement partners that we
may work with
• any business that supports our services and products, including any person that hosts or maintains any
underlying IT system or data centre that we use to provide the website or other services and products

• other third parties (for anonymised statistical information)
• a person who can require us to supply your personal information (e.g. a regulatory authority)
• any other person authorised by the Act or another law (e.g. a law enforcement agency)
• the registered owner of the vehicle you have used at a carpark facility (where necessary to enforce a
Breach Notice)
• any other person authorised by you.
PROTECTING YOUR PERSONAL INFORMATION
We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other
misuse.
ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION
Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable
personal information that we hold and to request a correction to your personal information. Before you exercise
this right, we will need evidence to confirm that you are the individual to whom the personal information relates.
In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to
change the personal information, we will make the correction. If we do not make the correction, we will take
reasonable steps to note on the personal information that you requested the correction.
If you want to exercise either of the above rights, email us at privacy@park360.co.nz. Your email should provide
evidence of who you are and set out the details of your request (e.g. the personal information, or the correction,
that you are requesting).
We may charge you our reasonable costs of providing to you copies of your personal information or correcting
that information.
INTERNET USE
While we take reasonable steps to maintain secure internet connections, if you provide us with personal
information over the internet, the provision of that information is at your own risk.
If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to
your personal information. We suggest you review that site’s privacy policy before you provide personal
information.
